New York State Police arrested a 34-year-old male on two separate occasions on November 23, 2023. The initial arrest stemmed from a domestic assault at a residence on Schuyler Court in Halfmoon, New York.
Kevin J. Decelle, 34 has been charged with second-degree harassment, second-degree criminal contempt, criminal obstruction of breathing, and fourth-degree criminal mischief.
At approximately 9:21 a.m. troopers were dispatched to the above address to investigate a domestic dispute complaint. Upon arrival, troopers learned that the suspect assaulted and obstructed the victim’s airway. The victim was prevented by the suspect from contacting law enforcement. It wasn’t until the suspect left the home the following morning that the victim was able to call 911.
The suspect was apprehended at his residence in Malta, New York, and later released on his own recognizance. A full stay-away order of protection was issued by the court to protect the victim.
Later that day at approximately 8:46 p.m. New York State Troopers were notified of the suspect attempting to call the victim. Troopers arrested the suspect for the second time at the residence in Malta in violation of the order of protection. The court released the suspect the suspect with an appearance ticket. A court date is scheduled for November 30, 2023.
New allegations surfaced later that the victim was sexually assaulted by the victim during the morning hours on November 23, 2023. Decelle was later charged with second-degree unlawful imprisonment and third-degree rape.
