Javier Vega-Funes arrested for murder of Jose Rubio who allegedly shot his brother

A man has been arrested in connection to Monday’s homicide in Austin, Texas. APD officers responded to 11215 Research Boulevard just before 6 p.m. on Monday after receiving a report of shots fired. One caller saw a man running and shooting while another saw someone shot in the back near an apartment complex.

A third caller told police someone had been shot by the HEB. At the scene, officers found Jose Rubio suffering from gunshot wounds at the intersection of 183 Southbound and Balcones Woods Drive. The victim was pronounced deceased at the scene. Officers learned that a second victim, David Cerda-Funes, was stopped off at an area hospital by a woman in a Chevrolet Tahoe.

The woman immediately left the hospital. Officers found the Tahoe in the parking lot of the hospital and discovered it was occupied by Javier Vega-Funes. APD says Vega-Funes attempted to flee on foot before being apprehended by officers. APD later learned the second victim was Vega-Funes’s brother.

Investigators believe Jose Rubio shot David Cerda-Funes at 11215 Research Boulevard before leaving the scene on foot. Javier Vega-Funes reportedly helped his brother into the Tahoe and caught up with Rubio who was still on foot. Vega-Funes allegedly got out of the Tahoe and shot Rubio near Highway 183 at the Balcones Woods Drive intersection.

The suspect has been charged with 1st Degree Murder. David Cerda Funes is still in critical condition in an area hospital.
