Albany, New York – The Albany Police Department has provided an update on Sunday morning’s officer-involved shooting.
According to an APD statement, officers responded to 150 Third Avenue for reports of a person with a weapon inside around 7:50 a.m. on January 5, 2025. Police say a witness informed officers that he observed 39-year-old Luis Rivera with a handgun inside the residence.
At the scene, officers gave commands to all individuals to exit the residence. A female and her teenage son exited unharmed. APD says Rivera exited but retreated inside and ignored officer commands.
It is alleged that Rivera exited the home again and assumed a “shooter’s stance”. APD says Officer Daniel Blossom discharged one round at Rivera missing him.
The officer took cover behind a police vehicle. Rivera again allegedly assumed a “shooter’s stance” and raised his hands in a shooting man. Officer Blossom reportedly fired again hitting Rivera in the leg.
Authorities confirm that Rivera was not armed at the time. He was transported to Albany Medical Center Hospital with non-life-threatening injuries. Police allege that Rivera subjected an adult female to several domestic violence related charges threatening her with a handgun.
APD’s Criminal Investigation unit carried out a search warrant and found a loaded 9mm handgun inside the home, according to police.
Rivera is on federal probation. He has been charged with one count of Attempted Assault 1st, one count of Criminal Possession of a Weapon 2nd, one count of Menacing 2nd, and two counts of Endangering the Welfare of a Child.
