New York State Police’s Bureau of Criminal Investigation arrested a 48-year-old man as part of an Internet Crimes Against Children Investigation. David B. Herby of Buffalo, New York was determined to possess material depicting a minor engaging in sexual conduct.

Herby was previously convicted of crimes in Pennsylvania and New York. Officers found loaded firearms, bulletproof vests, and a replica of a police badge in Herby’s possession.

Authorities have charged Herby with several counts of unlawful possession of a weapon, child pornography, a weapon with a defaced serial number, and body armor. Herby has also been charged with promoting a sexual performance by a child and distributing child pornography.
