According to a press release from the San Jose Police Department, a man has been arrested in relation to the death of an infant female. Police say officers from the San Jose Police Department responded to the 1500 block of Huddersfield Court for a report of an unconscious infant female on August 12, 2023 around 11:07 PM. The infant was later pronounced deceased at the scene. In accordance with Santa Clara County protocol for child deaths, the case was handed over to the San Jose Police Department Homicide Unit.
Homicide Detectives claim that the father, Derek Rayo, and a second suspect were responsible for the death of the infant victim. Detectives say they discovered evidence suggesting both suspects had knowingly left illegal and dangerous drugs around the victim. On November 2, 2023, the Santa Clara County Coroner’s Office informed Homicide Detectives that the victim’s blood contained a lethal concentration of fentanyl.
Homicide arrest warrants were later sought for both suspects. Authorities say 27-year-old Derek Rayo, of San Jose, has been in custody since August 13, 2023 for an unrelated warrant. Rayo was served with the homicide warrant on November 21, 2023. The second suspect is not in custody and is still being sought.
The victim’s identity will be released by the Santa Clara County Coroner’s Office after confirming the victim’s identity and informing the next of kin. The homicide is the 30th in the city in 2023.
